Welcome to Tarot & Twilight (“Tarot & Twilight,” “we,” “our,” or “us”). These Terms of Service (“Terms”) govern your access to and use of our websites, apps, content, products, and services (collectively, the “Services”). By using the Services, you agree to these Terms.

• Upload malicious code, attempt to gain unauthorized access, or interfere with the operation or security of the Services.

• Use the Services for scraping, automated data collection (except search indexing), or to build competing products.

We may suspend or terminate access for any violation.

4) Intellectual Property

All content in the Services—including text, graphics, logos, icons, images, audio/video clips, software, and designs—is owned by Tarot & Twilight or its licensors and is protected by copyright, trademark, and other laws.

• You receive a limited, non-exclusive, non-transferable license to access and use the Services for personal, non-commercial purposes.

• You may not copy, modify, distribute, create derivative works, or exploit the Services except as expressly permitted by these Terms.

• “Tarot & Twilight” and related marks, logos, and trade dress are trademarks of Tarot & Twilight LLC. All rights reserved.

5) User Content & Feedback

If you submit, post, or upload content (“User Content”), you grant Tarot & Twilight a worldwide, non-exclusive, royalty-free license to use, reproduce, modify, adapt, publish, translate, distribute, perform, display, and create derivative works of your User Content solely to operate, improve, and promote the Services.
You represent that you own or have the necessary rights to your User Content and that it does not violate any third-party rights or laws.
Feedback is voluntary, and we may use it without restriction and without compensation.

6) Products, Orders, & Pricing

We may offer physical goods, digital downloads, and/or services (e.g., readings). Prices, features, and availability are subject to change without notice. We may cancel or refuse orders, including for suspected fraud or errors.

Digital Goods & Custom Items

• Digital downloads: typically non-refundable once delivered or made available, except where required by law or if a file is defective (in which case we’ll replace or refund at our discretion).

• Custom or personalized items: sales are final unless the item arrives damaged or incorrect.

Shipping & Risk of Loss (Physical Goods)

Risk of loss passes to you upon our delivery to the carrier. Inspect packages upon receipt and contact us promptly if there is damage or an issue.

7) Subscriptions & Auto-Renewals (if offered)

If you purchase a subscription, it will auto-renew at the then-current rate unless you cancel before the renewal date. You can manage or cancel via your account or by contacting info@tarotandtwilight.com. Partial periods are typically non-refundable unless required by law.

8) No Medical, Legal, or Financial Advice (Entertainment-Only)

The Services—including readings, interpretations, spiritual guidance, and any astrological, numerological, or tarot content—are for entertainment purposes only. We do not provide medical, legal, financial, or mental-health advice. Always seek a qualified professional for such matters. You are solely responsible for decisions you make based on the Services.

9) AI-Generated or Automated Content (if applicable)

Some outputs may be generated or assisted by algorithms or third-party models. Such content may be inaccurate or incomplete. You should independently verify any information of importance.

10) Third-Party Services & Links

The Services may link to or integrate third-party websites, apps, APIs, or platforms. We do not control and are not responsible for third-party content, policies, or practices. Your use of third-party services is at your own risk and subject to their terms.

11) Privacy

Your use of the Services is subject to our Privacy Policy, which explains how we collect, use, and share personal information. Please review it carefully. By using the Services, you consent to our data practices described there.

12) DMCA / Copyright Complaints

We respect intellectual-property rights. If you believe material on the Services infringes your copyright, please email info@tarotandtwilight.com with: (a) a description of the work; (b) the infringing material URL/location; (c) your contact info; (d) a statement of good-faith belief; (e) a statement under penalty of perjury that your notice is accurate and you’re authorized; and (f) your physical or electronic signature.

13) Disclaimers

THE SERVICES AND ALL CONTENT ARE PROVIDED “AS IS” AND “AS AVAILABLE.” TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICES WILL BE UNINTERRUPTED, SECURE, OR ERROR-FREE, OR THAT DEFECTS WILL BE CORRECTED.

14) Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, TAROT & TWILIGHT AND ITS AFFILIATES, OWNERS, DIRECTORS, EMPLOYEES, AGENTS, AND LICENSORS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF PROFITS, REVENUE, DATA, OR GOODWILL, ARISING OUT OF OR RELATED TO YOUR USE OF (OR INABILITY TO USE) THE SERVICES, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
IN NO EVENT WILL OUR TOTAL LIABILITY EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID US FOR THE RELEVANT PURCHASE IN THE 3 MONTHS BEFORE THE EVENT GIVING RISE TO LIABILITY, OR (B) USD $100.

Some jurisdictions do not allow certain limitations; in those cases, the above limitations apply to the fullest extent permitted by law.

15) Indemnification

You agree to defend, indemnify, and hold Tarot & Twilight and our affiliates, officers, directors, employees, and agents harmless from any claims, damages, liabilities, costs, and expenses (including reasonable attorneys’ fees) arising from: (a) your use of the Services; (b) your User Content; (c) your violation of these Terms or applicable law; or (d) your infringement of any third-party right.

16) Termination

We may suspend or terminate your access at any time, with or without notice, if we believe you have violated these Terms or for any reason. Upon termination, the licenses granted to you terminate immediately.

17) Governing Law; Dispute Resolution; Arbitration

These Terms are governed by the laws of the State of Florida, without regard to conflict-of-laws principles.

Arbitration. Any dispute, claim, or controversy arising out of or relating to these Terms or the Services will be resolved by binding arbitration administered by the American Arbitration Association (AAA) under its Consumer Arbitration Rules.

• Venue & Language: The arbitration will occur in [Palm Beach County, Florida], in English, before a single arbitrator.

• Exceptions: You may bring an individual claim in small-claims court in your county of residence (or Palm Beach County, FL).

• Class-Action Waiver: You and we agree that each may bring claims only in an individual capacity and not as a plaintiff or class member in any purported class or representative proceeding.

• Injunctive Relief: Either party may seek temporary or preliminary injunctive relief in court to protect its rights pending arbitration.

• Opt-Out: You may opt out of arbitration by sending a written notice to info@tarotandtwilight.com within 30 days of first accepting these Terms, including your name, the email associated with your account, and a clear statement that you wish to opt out.

18) International Users

We operate from the United States. You are responsible for compliance with local laws. Consumers in the EU/UK may have additional statutory rights that cannot be waived by contract.

19) Changes to the Services or Terms

We may update these Terms from time to time. If we make material changes, we will post the new Terms and update the “Last Updated” date. Your continued use of the Services after changes become effective constitutes acceptance of the revised Terms.

20) Miscellaneous

• Entire Agreement. These Terms, along with any policies linked within, constitute the entire agreement between you and us relating to the Services.

• Severability. If any provision is found unenforceable, the remaining provisions will remain in full force and effect.

• No Waiver. Our failure to enforce any provision is not a waiver of the right to do so later.

• Assignment. You may not assign these Terms without our prior written consent. We may assign these Terms in connection with a merger, acquisition, or sale of assets.
